Introduction

Welcome to lespictures photography by sasha zhu ("we", "us", or "our"). By accessing and using our website, services, and products (collectively, the "Services"), you agree to comply with and be bound by the following terms and conditions ("Terms"). Please read them carefully.

 

Booking and Payments

1. Booking: To secure a booking, a non-refundable deposit of 50% of the total fee is required. The remaining balance must be paid 1 day before the session date.

2. Payment Methods: We accept payments via paypal, bank account or bank transfer. You will get an invoice with all necessary details for payment.

3. Cancellation: If you need to cancel or reschedule your session, please notify us at least 7 days in advance. Cancellations made less than 5 days before the session may result in forfeiture of the deposit.

 

Services

1. Scope of Work: The Services will be provided as outlined in the agreed-upon package or custom quote. Any additional services or changes must be agreed upon in writing and may incude additional charges.

2. Location and Time: The client is responsible for ensuring the location is accessible and safe for the photographer. Any delays or issues caused by location access or client tardiness may affect the quality and quantity of photos delivered.

 

Image Delivery

1. Turnaround Time: Edited photos will be delivered within 3-6 days of the session date. For weddings and large events, the turnaround time may be up to 2-3] weeks.

2. Delivery Method: Photos will be delivered via a private online gallery, where high-resolution images can be downloaded. Prints and albums can be ordered separately.

3. Image Rights: Clients receive personal use rights for all delivered images. Commercial use or redistribution of images requires written permission and may incude additional fees.

 

Image Usage

1. Photographer’s Rights: We retain the copyright to all images and reserve the right to use them for portfolio, marketing, and promotional purposes unless otherwise agreed in writing.

2. Client’s Rights: Clients are granted a non-exclusive, perpetual license to use the delivered images for personal purposes. This includes printing, sharing on social media, and personal display.

 

Liability

1. Limitation of Liability: We take the utmost care in capturing and handling your images. However, in the unlikely event of a technical failure, loss, or damage, our liability is limited to the refund of all payments received or a re-shoot at no additional cost.

2. Indemnification: The client agrees to indemnify and hold harmless lespictures photography by sasha zhu, its owners, and employees from any claims, damages, or legal actions arising from the client’s use of the Services.

 

Privacy

1. Data Protection: We are committed to protecting your privacy. Personal information collected during the booking process will be used solely for providing the Services and will not be shared with third parties without your consent.

2. Confidentiality: All personal information and images are treated with confidentiality. We will not use your images for promotional purposes if you have requested privacy.

 

Dispute Resolution

1. Governing Law: These Terms are governed by and construed in accordance with the laws of Government of Germany.

2. Dispute Resolution: Any disputes arising from or related to these Terms or the Services will be resolved through [mediation/arbitration/court jurisdiction].
